If consent is given, the noncustodial parent will sign legal documents and not need to appear in court. Further, if the noncustodial parent does not consent, termination will require court involvement.

2. Legal Process and Documentation: If all parties consent to the adoption, the only parties attending court will be you, your spouse, and the adopted child. However, if the noncustodial parent does not consent, then court you will go to court. At court, an attorney should be representing the noncustodial parent. And an attorney should be representing you (the adopting step-parent) and your spouse (the custodial parent). Often, the court will appoint a Guardian Ad Litem (an attorney) to represent the child’s interests.

If the noncustodial parent’s rights are terminated, the step-parent adoption will be on a different day. Family and friends will be able to attend.
